Whether or not a rape actually physically happened though surely?

if the physical offence/incident can't ever be proven I'm really struggling to see how a jury could ever be sure enough to convict.

Anyway we could debate all night, safe to say a very difficult area and I am sure it is often a very tough judgment call for the CPS.
