We will have to disagree but I think you've just applied the wrong test on the CPS

The CPS have to test whether they believe a jury is more likely than not to convict on the evidence the CPS will present and the likely defence.

That's not the same standard that the jury have to apply. They can find the defendant guilty only if they are sure that the offence happened.
