I think there's possibly something of an argument

depending on how the season is ended, because the risks are not equally distributed, and so the effects of a given course of action will also be uneven ..... but all of that has to be considered in light of the terms actually agreed between the clubs, or to be read into their agreement - it's not "unfair" to do what you're allowed to do even if it's selfish and not very nice to do it - and on what are the genuinely available alternatives - i.e. clearly something has to be done, some course of action taken - and whatever it is, it won't be without harmful consequences of some sort.
