I've read through your posts and the advice from both Simon and Saucerer a couple of times. Obviously I don't have all the facts at my disposal but quite frankly I'm appalled at the behaviour of management; if an individual has a history of unsatisfactory behaviour and previous claims against them, why hasn't something been done? Thus smacks of incompetence or an unwillingness to face up to a difficult situation.
As a minimum I would expect that the individual concerned would have been guided to some self awareness or managing their own impact development, but from the limited information this may go beyond that sort of approach.
Let me say I'm not an HR professional, but have led teams and groups of teams for almost 30 years and have conducted a number of independent investigations with HR colleagues as well as mediating several disputes between managers/staff and between colleagues. In recent years I do some coaching and mentoring. The behaviour of your HR in 2004 was disgusting, I would sincerely hope this was not typical and, yes, the world of HR has moved on.
I'm surprised that there isn't already a behavioural component to performance that could be used by management as a lever but, having 'managed a few exits' myself, sometimes there is a need for a final nail which can then be used to get a strong case.
I'm sad and disappointed that you feel that you may need to endure the situation or seek a move yourself. This shouldn't happen in this day and age. Obviously it is a personal choice and one you need to be comfortable with. I have seen these sorts of things end well, equally I have seen them create further disharmony but it does sound as though colleagues would back you.
I can't get over why nothing has been done before, sorry to fixate, but this really annoys me and I have to question why? Is the person very productive or a critical member of staff? This doesn't excuse inaction but I've seen poor and weak management of 'so called' experts in their field before and it stinks and leads to bullying and harassment.
Apologies for wading in and this certainly isn't the best place for such a complex discussion, but as a senior manager and leader this sort of inept management infuriates me and places employees such as yourself in a difficult and often despairing position when all you want to do is go to work, get on with it and be treated with respect whilst you are there.
