UEFA's rules do not state the top 4 in the Prem are guaranteed entry but that it is for the FA to decide how the 4 places are allocated. The FA's own rules (as stated on their website) are that normally the top 4 in the Prem will be entered but in the exceptional circumstances of an English team winning the CL and not coming in the top 4 they would get the 4th CL place and the 4th Prem team would go into the UEFA Cup (i.e. they would follow the precedent followed by the Spanish FA a few years ago). Unfortunately - and agaisnt their own rules set out at the start of the season - the FA announced Everton would definitely get the 4th place. Now there is pressure from evryone that Liverpool should be allowed to defend their title (a chance the FA have denied them). My solution would allow them to do that while still giving Everton what they thought they were getting (a CL qualifying game - 4th place gives them no right to a place in the competition proper) and which is actually MORE than the would have got if the FA had followed their own rules.
