BitTorrent encryption doesn't help I'm afraid...

Apparently, BPI agents are joining torrent swarms and recording the IP addresses of uploaders and then sending them to VM and if they are a VM address a letter is sent out. Clearly they are - for the moment at least - preferring this tactic rather than collecting hard evidence for prosecutions.
