As CWC says, to placate the EFL/FA you would probably need to

allow some sort of promotion but the EPL could pass the buck on how that is achieved to the EFL!

So it would all depend on whether there is the potential to somehow get 14 teams to agree to an expanded premier league for a season or two in order to remove scope for litigation and "share the pain."

As you say probably wishful thinking given the levels of self interest of all parties.
