you've probably got an easement so no they cant but
note the 'probably', and that it's probably time to dig out your title deeds and any bumphf your solicitors gave you when you bought the property (or sold the land that the tank is sitting on)
disclaimer: I haven't touched property law for 10 years.
I will ask our property lawyer at lunch (if I can work out how to bring up the topic of you s**tting in someone else's garden into the usual 'first week of big school' chat).
