I was going more along the lines that he desparately needs to go down the route of proving he thought it was an intruder rather than knowing it was his girlfriend (ie the mistake being as to identity of who he shot), and playing the fact that he killed a loved one rather than an intruder as a way of mitigating the sentence.

If it comes out at all that he knew it was her, then he's utter toast. Except in France, obv.
