No, not if you are in your own home and in fear for yourself or others. In those circumstances the law does not require you to wait to be attacked before using defensive force yourself.

I.E, someones in your home, your s**tting it and scared to death he's going into your nippers bedroom. You attack, No5 iron to the side of the noggin. Seems to me that the CPS is saying that's probably ok.
