if someone hit me first then i'd hit back using appropriate force....

with a burgler in my house I'd try to detain him and esculate the violence level as appropriate, whilst staying under control. Once apprehended I wouldnt go and beat him etc, which a court would see as losing control and taking vengence, dishing out punishment etc....
