I suppose you can justify it either way
It's in the nature of a parachute payment that it's to protect against costs of relegation - it's not just a freebie - so if you've not been relegated, why should you get it or any part of it? After all, that's why re-promoted clubs don't get it - because they're no longer in the Champs, they don't need it to meet "EPL liabilities".
Or, the EPL having saved that amount, which it would have lost, it would be generally beneficial to hand it out to everyone.
