It’s a grey area

In practice yes the Tory party members are picking the new prime minister but in theory they aren’t.

They are selecting the new leader of the Conservative party which they are entitled to do.

MPs will then vote to make that leader prime minister (or not) which is constitutionally correct.
It is possible that boris May win the leadership but have MPs vote against him and we could get a general election.
