what's this about 'the rules'?

the only precendent for this is a few years ago when Real madrid won the CL and came 5th in the league. Next year they were given a CL place and Zaragoza (who came 4th) missed out. A team coming 43th has NEVER been given preference over a CL winning team before so unless the rules have been specifically changed....
