There's some criminal negligence in there somewhere, but I doubt from the manufacturer....

they warn about it in their sales brochure, so for me the blame has to lay with the designers, suppliers of the panels, the main contractors and the council and probably a combination of all four, but not the manufacturer.

If a customer specifies a particular product, which seems to have been the case here, what do you do?

If you don't supply it, a competitor almost certainly will. All you can do is make the product specification as clear as possible, which does seem to have been done here. It may come down to how much they did or didn't know, as Jim says.
