Someone is legally in the wrong I would say
Whether it's the contractor for saying they would use a certain type of panel and then using a cheaper one to save costs or be building regulations department for negligently signing off the building with non compliant panelling. Those are the two angles I suspect will end up under focus.
I take your point re moral culpability but then I don't know how much knowledge the seller has of the ultimate project in such cases. It may be that they just receive an order for x amount of x type panels and don't really know if it's being used on one talk building or several smaller buildings. If that's the case then I think it's stretching it a bit to blame them. If however they knew the exact proposed use it's a different matter.
