The laws of intestacy and probate are, whilst complex, very robust.

The executors and other beneficiaries can't just divi the estate at their whim. Like someone mentioned below, some assets or cash may have already been distributed, but the value of the estate in its entirety at the point of death, is what must be used when determining the final distributions.
