Any insurance / building contractor bods?
The flat I lived in has a developer building additional flats on the top storey.
They tested that the roof was waterproof by putting a hose on it for the weekend and leaving. It wasn't waterproof, water came down an internal wall and out the ceiling of our flat, damaging the tv and some other items.
Builders have accepted liability and offered to cover on insurance. They are offering cash - no direct replacement - and have today indicated that this won't be on a new for old basis. I'm unsure whether this will mean if I can afford to replace with a like for like replacement (i.e I had a Samsung TV) and a discontinued guitar amp.
I don't have insurance cover of my own. Am I in a position to expect new for old replacement, are the builders liable? Could I take them to small claims court for damages?
