I may be wrong, but doesn't the indemnity only work if you and your
solicitors are unaware of the issue. So it's a way of the solicitor covering their arse if they haven't done their job properly because they are too busy playing golf or doing whatever else solicitors do. If you know about it doesn't it muddy the water slightly. Definitely worth discussing with your solicitors though.
