As far as I know small/non league clubs need to state how many they can accomodate and stick to that number. (This might be at their ground or a local one that can hold a few more - not sure about this bit)
The was a big old row a few years ago, when Farnborough drew Arsenal at home, and the game was switched to Highbury, and I think it's because of this that this rule came about.
