Like you say the Belgian jurisdiction complicates things but

To my mind the fact that AZ appear to have been consistent must also surely be in their favour.

They were supposed to deliver 30m doses to us last year but didn't due to similar production issues. This seems to me to be almost exactly the same scenario playing out with the EU 3 months later.
