Can't remember the specific detail of his points, but was of the opinion that the restriction of trade argument was a non-starter, given the specific differences in footballers contracts of employment.

I remember him saying that headhunting (tapping-up) is specifically not illegal in normal business, but then in normal business employees are rarely is effer considered assests with a real monetary value. If normal bussinesses had to go to a tribunal to agree compensation to a rival for hiring a chap under a particular age from them, I'm sure there would be things said then about the legality of headhunting.
