The key part is "a threat to life was imminent"

I don't believe there's such a thing as "shooting to wound" and if he had had a gun then firing warning shots may not have been a very clever thing to do as he'd have had the chance to get rounds off.

Thing is though he was actually unarmed, so threat to life wasn't imminent.
