Look at the bigger picture...

it won't be fair should the uninsurred driver kill or injure someone next time around.

It isn't fair that unisured drivers mean that everyone else has to pay more for insurance.

Teach them a lesson and they might think 'Oh we should have been insured, we had best buy some insurance'.

Also get a letter from them to confirm that they will not be following up on their claim. Once you have that then tip off the police.
