The Trade Marks Act 1994 just called and you are in breach of the trademark act section 3: Absolute grounds for refusal of registration, para 3; A trade mark shall not be registered if it is (specifically) sub para (b) "of such a nature as to deceive the public, for instance as to the nature, quality or geographical origin of the goods or service".
A misleading action can be a criminal offence under section 237. The possible penalties include:
on summary conviction in England and Wales: a fine;
on conviction on indictment: an unlimited fine, imprisonment for up to two years, or both.
Separately, the CMA can use civil enforcement powers, potentially including a penalty of up to £300,000 or 10% of the business’s worldwide turnover, whichever is higher.
