Yes there's a fundamental difference. When Leeds did it, there was actually no

specific rule against it, so they were only able to punish them under the rule for "treating teams with good faith".

Immediately after the Leeds spy gate, the EFL brought in a rule prohibiting teams from watching opponent training sessions in the 72 hrs before the game (unless invited).

I don't know what the punishments are for that, but they could certainly be more severe than Leeds got simply because the rule is now there.
