i suppose probably yes, though one may get tricky points about vitiated consent - and whether in the civil case it matters whether he thought she was consenting or not (or didn't think about it or care etc) I don't know

anyway, he's not going to argue it ..... and he can hardly now turn round and say, ooh, I've just remembered all about it, and yes, she was very willing, whether or not she was also being paid handsomely.
