without wanting to polarise the situation, it was my wife's car
in mitigation the battery died so i logged on to europarts, punched in the registration and it offered up a selection of batteries that fit that particular model. after i had removed the old one and put the new one in and fitted it all back together it was clear that the battery was a lot smaller so the clamp didn't clapm dowmn on the battery. so i put a shim of wood undernath to raise it up a bit so the clamp could do it's job. i should have took the battery back and got them to change it for a bigger one i suppose but the workaround works.
