guess it spends n what the agreement between the EPL and EFL says about it. If it's left for the EFL to determine how it selects the 3 teams to be promoted at the end of the season, and they pick 3, then probably not a lot the EPL can do about it.

Similar issue brewing between L2 and National League. The NL have ended their season but they haven't decided how to decide promotion, and that also assumes the League will let two clubs up (which depends on what's happening between EPL and Champs, and Champs to L1, then L1 to L2).
