The morals enshrined in law need to reflect the society that the law serves.
As much as the court of public opinion is a pain in the arse some of the time, it is one of the key components of the checks & balances that keep the law evolving and helps keep governments in check.
After all, we'd still have the death penalty and homosexuals in prison were it not for people judging others by a different moral code of conduct than the one enshrined in law.
eg there is a greaterchance of the FCA more closely regulating how advisors sell tax-efficient investments, (and this leading to some of the dodgier schemes becoming less attractive to market (and invest in)) if public opinion flays its chairman and he feels a bit silly/misled by his advisors, than if we simply wait for Govt to legislate.
