It's rubbish of course, but if that is how the rules are applied then they should be applied consistently.

If the ref had seen the contact he would have given the penalty, I'm sure of that.

Aguero's dive actually cost him the penalty. It wasn't necessary. It made it look like he wasn't fouled, when he would have been.

So I guess the ref got it right, but probably for the wrong reason. I'm still sure he'd have given it had he seen the contact.
