I personally used this technique in 2004.

there is nothing illegal about this technique. The player did not mark the cards, he is just using info available to any player observing the game.

In my experience casinos are very bad losers. They love it when mug punters blow all their money when they have the mathematical edge but when somebody wins they will look for any excuse not to pay.
