yes i agree, but my get out clause is that......

I was having lunch in the company canteen with my boss....I was happy with the glass of water and would have purchased a cup of tea AFTER said meal.....(mainly to kill another 10 minutes before coming back to the office) BUT my boss got up to get himself a coffee and without asking automatically brought me one back too! who am I to turn down a free coffee??!!

would that stand up in court?!
