Well the BPI are only concerned with music

AFAIK so they wouldn't have anything to say about software and movies. And they also don't seem to have anything to say about downloading really: "customers whose accounts appear to have been used to distribute music in breach of copyright will receive informative letters" - seems to me that they are going after the uploaders.

It surprises me that most "illegal" downloading is via p2p. Can that really be true? It all seems very 2004 to me.

And I don't understand this: if I download a file from the internet how can anyone tell if it is legal or not?
