There is a difference between what the law is trying to achieve and.....

the strict interpretation.

The ref asks two questions.

1) Did he do so deliberately?
2) Did he seek to gain an advantage in doing so?

Only if both are answered yes will a caution be considered and even then, you'd probably warn them first. It's a bit petty to do so first time up.
