Have I missed something

Have we all slipped into the film Minority Report.
You can now be arrested and banned from football matches if you have the potential to be a hooligan.

"Alternatively, a ban can be requested where police have kept records on an individual who could potentially be violent at matches. Both orders have similarities with anti-social behaviour orders."

What is going on here surely if this happened you could take it to the european court of human rights.

I can see this becoming more poular though as the government site "protecting us from terrorism" as their reason.
