Basically.....

If the fence is inside your boundary (where it shouldn't be) then you (the owner) has 12 years to claim the land back. If the person (neighbour) who is adversely possessing the land (squatting as its commonly known) can prove a 12 year tenure then he can claim it for himself. There are qualifiers to this but that is the basics.
