Her position of Deputy Leader and therefore Deputy Prime minister is selected by the party not the leader. She would have to resign from that first.
She received crap advice from the legal profession as she has complex personal finances.
With the utmost respect to those on here in that profession my experience has always been that lawyers work on the basis of getting you the answer that you are looking for as they make their money (especially barristers) out of having arguments as to how the law can be interpreted.
This is a classic political mountain out of a molehill scenario. IF evidence emerges that there was advice that she should pay the full amount and chose not to then yes she should resign but until then she has done nothing wrong and probably her lawyers have notified their E&O insurers of a potential claim.
