I can see Andy has offered specialist advice and you'd be well advised to contact him. But if I can help in any way I'm happy to do so.

In June 2019 my Mum suffered a brain aneurysm. A week later my Dad had a heart attack and died. My Mum was in a coma for several months and their wills (dated 1989) effectively did the same as your Dad's latest will, leaving everything to each other with no thought over what would happen in an emergency.

Heck, the will was so old and so out of date that my brother and I - both in our late 30s at this point - were left to the care of my Aunt!

I had to apply to the Court of Protection for a deputy ship order to allow us to get the probate of my Dad's estate sorted. It took time (even as an emergency application) and lots of form filling - but you will get there in the end.

I wish you and your family all the best - I can only imagine the stress you're under but know you will get there in the end.
