The offence is spitting at a someone

My reading of that would be “at” requires intent to spit at them.

But for there to be a charge at all, the fa must be saying either they think he did intend to, or otherwise that intention isn’t relevant if he’s been reckless.

Let’s see what the wording of the charge is.
