I think

We need to re examine the whole Victorian colonialist construct of "the rules", designed, as surely they were, by a small group of privileged white men, in order to suppress and marginalise "the other" through the use of value laden terms such as "foul" and "penalty".

But leaving that aside... yeah, it was a foul I reckon.
