Labushagne was trying to gain an advantage by being out of his ground.

The only appropriate comparison in my mind, is a Mankad, with no advance warning. And even then, it's worse than that because Bairstow wasn't doing anything to try and gain an advantage, he just (wrongly) thought the ball was dead.

Very, very poor form.
