HMRC have strict governance processes to go through in determining what does and does not warrant a penalty. It is not difficult to avoid a penalty. If you take advice from a reputable adviser, and follow that advice, then are transparent with HMRC in discussing the position you’ve taken, they won’t fine you even if they disagree.
