The employment tribunal upheld a claim of direct discrimination on the protected characteristic of race under the Equality Act 2010 s.13 arising from a colleague's comment to an individual who identified her race as Latino that she would have suffered oppression because of her race and the colour of her skin. The assumption that she must have suffered oppression because her skin colour was not white was a form of stereotyping which had caused her genuine upset and distress. She was awarded £14,000 for injury to feelings.
