You are very naive. It is extraordinarily easy to manipulate a trust structure. See all the recent battles over assets held by oligarchs via nominee structures in discretionary trusts (Lakatamia Shipping or Ablyazov or Solodchenko).

The question you asked was: "what evidence is there that Tom will be given the club?"

I would have thought that a statement from Delia that "he will be the recipient of our shares" is reasonable evidence for that proposition.
