Because

there is a fundamental right to liberty which is plainly (& dramatically) affected by a rule criminalising gatherings of more than 6. That infringement must be proportionate in order to be lawful. I would have thought it's arguably disproportionate - apart from setting a reasonably terrifying precedent.
