The problem

is not the length of the prorogation or its effect of shutting parliament per se - it's the length & effect in this instance, combined with no proper reason. Saying you're proroguing for weeks & weeks to prepare a queen's speech is rubbish, and it left the ground completely open for a finding that there was no proper reason.
