That's got to be the issue surely?

You cant enforce a convention but the courts must be able to prevent the abuse of convention. Otherwise the exec is above the law and that's a nonsense.

Difficulty here being its not really a clear abuse given the trivial loss of additional days and plenty of days before and after for parliament to do what it wants re Brexit (amply demonstrated by being able to do the SO24 debate and extension bill)

Faod I have not read any of the judgments, so this point may have been addressed. It's all far too much like Public Law II from second year LLB course for my liking
