It raises quite an interesting issue (if you are a bit sad like me) actually because

Scottish constitutional law is apparently slightly different to English hence why a very similar case in London lost.

I really have no idea how the supreme court (which I assume has to consider both Scottish and English law) reconciles that situation (i.e. which wins out in the event of a slight conflict.) I guess they will try to stretch the relevant principles to come to what they think is the "right" outcome.
