£10bn is a figure some Brexiteers thought we might get away with arguing in a court of law that. A significantly higher figure is what the EU think we would owe.
We settled on £39bn based on a March exit, it's a bit lower now as we've been paying some of that money through being members for longer (although the £ buys less € so maybe it's back to be closer to £39bn....)
It's not a fee for having the withdrawal agreement, it's us settling our mutually agreed obligations with the EU as members. If we don't pay it we either never get a trade deal with the EU or we end up in court over it.
